One question stops parents in their tracks: who would look after my children if I wasn't here? Debbie Koziol, estate planning consultant in Cheshire, explains why appointing guardians in your Will is one of the most important decisions you can make.
When I speak with parents in my own circle of close family and friends, one thing is always clear: they spend so much of their lives protecting their children and planning for their future.
But when we talk properly, there is one question that often stops people in their tracks:
Who would look after my children if I wasn't here?
It is not an easy thing to talk about, especially with people you care about deeply. But I have seen how valuable that conversation can be. Once parents choose guardians in their Will, they often feel real relief knowing the people they trust most would step in for their children.
What Is a Guardian?
A guardian is someone you legally appoint in your Will to care for your children if there is no surviving parent with parental responsibility.
They would make day-to-day decisions about where your children live, their education, healthcare and overall wellbeing.
For many families I have spoken with, this is not simply about choosing the nearest relative. It is about who really knows their children, understands their values and could offer love, stability and everyday care.
Why Does It Matter?
Many parents assume close family or trusted friends would naturally step in. In many cases they would want to help, but without anything written down, it may not be straightforward.
Without a legally appointed guardian, family members may disagree about who should care for your children. If agreement cannot be reached, the courts may have to decide.
By appointing guardians in your Will, you give your family and friends clear guidance, remove guesswork and help everyone focus on caring for your children.
The Value I Have Seen for Families
Stability for Your Children
For parents I have spoken with, the biggest comfort is knowing their children would be cared for by someone familiar, trusted and chosen with love.
Less Stress for Loved Ones
Talking this through also helps loved ones. Instead of guessing what you would have wanted, they can take comfort from knowing your wishes are clear.
Reduces the Risk of Family Disagreements
Even close families can have different views when emotions are high. Putting guardians in place helps avoid uncertainty and gives everyone a clear direction.
Protecting Your Family Values
My conversations with close family and friends often come back to keeping children close to people they know, maintaining relationships and routines, and making sure they are raised by people who understand what matters to their parents.
Choosing the Right Guardians
There is no single perfect answer. What helps is starting the conversation and working through the practical and emotional questions together.
Some of the questions I encourage parents to think about are:
- Do they have a strong relationship with my children?
- Are they emotionally and practically able to care for them?
- Do they share similar values and parenting styles?
- Would they provide a stable and loving home?
- Have they agreed to take on this responsibility?
It can also be reassuring to appoint substitute guardians, in case your first choice cannot act. For many families, having a back-up plan brings extra peace of mind.
Don't Overlook Financial Planning
Once guardianship is discussed, financial planning often becomes part of the same conversation. Parents want to know who would care for their children and how they would be supported.
Your Will can also set out how money and assets should be managed for them, with trustees looking after their inheritance until an age you consider appropriate.
Some parents choose the same people as guardians and trustees, while others separate the roles. Talking this through helps families feel clearer about what would work best.
One of the Greatest Gifts You Can Leave
No parent wants to imagine a future where they are no longer there. But from conversations with close family and friends, I know how powerful it can be when parents make these decisions. It turns a difficult subject into an act of love, care and responsibility.
A professionally drafted Will allows you to appoint guardians, protect your children's future and give clarity to the people closest to you. If the unimaginable happened, your family and friends would know what you wanted.
If you have young children and have not yet appointed guardians, or if your circumstances have changed, it may be time to talk it through. A simple conversation can give you, your children and the people who love them security, certainty and peace of mind.
